In Santa Clara County, a jury found Shahin Gheblehshenas guilty on three felony counts of child endangerment. The verdict came quickly after a three-week trial, showing how clear the evidence was to jurors.
Her daughter, Nina Fathizadeh, who helped run the daycare, had already pleaded guilty earlier, accepting her role in the incident.
What Happened on the Day of the Incident
The incident took place in October 2023 at an unlicensed home daycare. On that day, several toddlers were present, and due to limited staff, proper supervision was not maintained. The children were allowed into the backyard where a swimming pool was located.
Unfortunately, the pool gate had been left open, which created a dangerous situation. Despite knowing that the gate had previously been left unsecured, no one checked it before allowing the children outside.

While the caregiver stepped away for a few minutes, the children were left without direct supervision. During this short time, three toddlers managed to enter the pool area.
