The parents of a 10-year-old girl with autism in Minnesota now face upgraded charges in connection with her tragic death. Heather Lynn Cross and Darcy Ronald Cross were initially charged with manslaughter, but prosecutors have now filed two counts of second-degree murder following new revelations in the case.
Death of 10-Year-Old Daughter
The 10-year-old girl, whose identity has not been publicly released, died after being left unsupervised for hours in a “safety bed” that was designed to keep her confined. According to an updated probable cause affidavit, authorities allege the girl was crushed by the bed, which prevented her from escaping or unzipping the covering. Investigators suggest that the parents’ neglect directly contributed to her death.
The affidavit further alleges that the girl was left alone for up to 10-12 hours at a time with no supervision, which led to her fatal injuries.
Fraudulent Claims and Abuse of Assistance
In addition to the murder charges, the couple now faces four counts of wrongfully obtaining assistance by false statements and impersonation. Investigators allege that Heather and Darcy Cross misrepresented the needs of their surviving daughter, leading to overpayments of more than $5,000 through Minnesota’s MnCHOICES program, which supports individuals with long-term service and support needs.
The investigation revealed that the Crosses exaggerated their surviving daughter’s needs, causing an increase in the funds they received for her care. Over the course of three years, these misrepresentations resulted in over $20,000 in fraudulently obtained funds. The surviving daughter, who is also diagnosed with autism, was placed in protective custody after the investigation began.
Tragic Discovery and Initial Investigation
On August 25, 2025, first responders arrived at the Crosses’ home in Pine River, Minnesota, where they found Heather performing CPR on her deceased daughter. Authorities reported that the victim’s body showed signs of rigor mortis, indicating she had been dead for hours before responders arrived. The room where the child was found had an overpowering odor consistent with urine and feces, and there were soiled mattresses and only a safety bed present.
Heather reportedly told investigators that the conditions were normal and explained her daughters’ behaviors by labeling one as a “fecal painter” and the other as an “escape artist.” She also described her late daughter as nonverbal and stated that she suffered from Pica, a disorder where individuals eat non-food items.
Parents’ Arrest and Legal Proceedings
After the Crow Wing County Sheriff’s Office and Crosslake Police Department responded to the scene, Heather and Darcy Cross were arrested on September 17, 2025. They face charges of second-degree murder, child abuse, and fraud. Their surviving daughter was taken into custody by child protective services, and authorities are continuing to investigate the case.

The case has brought attention to the issues of neglect and abuse within families struggling with disabilities, highlighting the need for proper care and oversight. The couple’s criminal behavior has left their community reeling, and justice for their daughter is still being sought.
The 12th Circuit Solicitor’s Office will prosecute the case, and Heather and Darcy remain in custody as they await their court proceedings.
