A Kentucky couple, Shawn Durbin (39) and Nancy Ann Durbin (36), has been charged with murder following the death of their neighbor, 62-year-old Bobby Pennington. The incident occurred on November 13, 2025, at an apartment complex in Elizabethtown, Kentucky, when the couple allegedly dragged Pennington from in front of their apartment and threw him over a second-story balcony, resulting in an 11-foot-6-inch fall onto a concrete pad. Pennington was transported to the hospital in critical condition and died four days later, on November 17.

The couple was initially arrested on first-degree assault charges, but these were upgraded to murder after Pennington’s death. Shawn Durbin also faces additional charges of two counts of third-degree assault and resisting arrest after reportedly attempting to kick out a police car window, spitting on an officer, and fighting with law enforcement during his arrest.

The couple was indicted by a grand jury on November 20 and is scheduled for arraignment on December 9. They are currently held at the Hardin County Detention Center on $500,000 cash bond each. According to police, there was a prior dispute before the assault, but the motive remains unclear, and authorities continue their investigation. Neighbors described the attack as senseless, emphasizing that Pennington was known as a friendly man who caused no trouble.
