A Texas woman was recently jailed for threatening to shoot a judge during a truancy hearing, according to Lone Star State authorities.
Daisy Hernandez, 19, faces one count of terroristic threat against a public official, according to law enforcement.
The underlying incident happened on Thursday, according to arrest records obtained by Waco-based CBS and Telemundo station KWTX.
The hearing in question was held at Precinct 5 Justice of the Peace Court. During the hearing, Justice of the Peach LucyAnn Sanchez-Miramontez questioned a member of Hernandez’s family about why her children were not in school.
The defendant’s mother reportedly started speaking, but the justice of the peace quickly looked away.
One of Hernandez’s brothers “caught the judge’s attention by smiling visibly and silently laughing,” according to the arrest affidavit. Then, the judge of the peace halted the hearing to handle the problem, reportedly instructing the kid to cease laughing or leave.
That interruption apparently did not go over well.
“(He) didn’t stop,” the affidavit states. “The judge informed the defendants that she would address this by sending their mother to jail for six days for violating a court order for truancy. Daisy remarked to the Judge, ‘You can’t do that.’ Judge replied, “Yes, I can.”
After some time, the defendant allegedly began “to yell” at the justice of the peace; Sanchez-Miramontez apparently became so upset that she shattered her judge’s gavel by repeatedly hammering it down on the sound block to quell the developing furor.
Eventually, the enraged judicial officer directed deputies to remove the Hernandez family from the courtroom, which they did.
The defendant apparently objected to the removal and allegedly stated, “I’m gonna shoot this b-.”
“Did she say that?” The now-confounded justice of the peace responded to the purported threat.
According to the affidavit, witnesses in the courtroom would later make statements about the incident.
“When things settled down, I asked Daisy why she told the judge she was going to shoot her,” the document, written by a subordinate constable, continues. Daisy said, ‘I don’t know.'” “I was angry.”
As it turned out, the underlying incident was finally resolved.
On Friday, Sanchez-Miramontez stated that Hernandez’s mother was in court to face previous truancy claims, but she eventually supplied paperwork that her children had begun attending school.
“I give families every opportunity and offer them every community resource to comply with court orders,” the judge added, according to KWTX.
According to the TV station, the suspect was originally held on a $5,000 bond.
The charges against Hernandez are not currently in the McLennan County criminal court docket, and the defendant is not listed as an inmate in the McLennan County Jail.
