Newman was driving with a woman passenger and another man when they picked up Fagin, who immediately displayed a stolen gun. After buying alcohol at Walmart, they went to the park on Blooming Grove Drive, where Fagin made the disputed call and grew agitated during the argument. Newman suggested fighting outside, but Fagin refused, stated “No, I’m going to shoot you,” and fired at close range.​

Authorities charged Fagin with murder, pointing a firearm, and unlawful handgun possession due to a prior felony.
