CHARLESTON COUNTY, S.C. — A public hearing is scheduled for Monday afternoon regarding an appeal that challenges a zoning decision linked to a proposed mining operation in McClellanville. The Charleston County Board of Zoning Appeals will meet at 4 p.m. to consider the appeal filed by the South Carolina Environmental Law Project, on behalf of Friends of Coastal South Carolina and the South Carolina Coastal Conservation League.

The Appeal: Disputing Zoning Exemption

The appeal contests a determination made by the county’s zoning department that classified a proposed mining and excavation operation as exempt from zoning regulations. The proposed site spans approximately 35 acres, split across two parcels near the intersection of U.S. Highway 17 and Lofton Road, situated within an Agricultural Preservation district.

According to the filing, the conservation groups argue that the exemption would allow the mining project—previously denied approval—to proceed without public notice or a hearing. In August 2023, the Board of Zoning Appeals had denied a special exception request for mining at the same location, citing concerns over incompatibility with the surrounding land and potential risks to public health and safety. The site is located roughly 900 feet from St. James-Santee Elementary-Middle School.

Earlier Denial and Current Appeal

That denial became final in March 2025 when the developer voluntarily dismissed a court appeal. Now, the current appeal challenges the zoning exemption, arguing that it circumvents the earlier ruling and prevents public review of the project. Additionally, the appeal contests the county’s handling of the matter, asserting that the issue should have been reviewed by the Board of Zoning Appeals.

The conservation groups are asking the board to overturn the exemption decision and require that any mining proposal for the property undergo the full zoning and land development review process, including a special exception request.

Public Participation and Hearing Focus

County officials have indicated that Monday’s hearing will primarily address whether the appeal was filed within the required time frame. Organizers are encouraging members of the public to attend and provide their comments during the meeting, which will be held in the council chambers.

This hearing will play a critical role in determining whether public input will be included in the review process for the proposed mining operation in McClellanville.
