A lawsuit claims that a Charleston restaurant offered alcohol to an underage motorist before the crash.

Debra Homicki filed a wrongful death lawsuit in Charleston County, South Carolina, against underage driver Angelyna-Cora Patricia Coleman and entities tied to Taco Boy restaurant (Taco Boy Dos, LLC, All Good Industries, LLC, and server Clara Morse at 217 Huger St.). The suit alleges the restaurant negligently served alcohol—a hibiscus margarita and Long Island iced tea—to Coleman, then under 21, without checking ID, foreseeably contributing to the fatal crash.

Crash Details

On February 19, 2023, Coleman drove Reece’s Honda Accord at 87-94 mph in a 35 mph zone on Savannah Highway, striking Todd Homicki in a crosswalk near Magnolia Road in West Ashley; he died at the scene. An expert estimates her BAC at 0.048%-0.085%, with impairment alleged; she later pled guilty to reckless homicide.

Homicki seeks actual/punitive damages via negligence, gross negligence, and strict liability claims, demanding a jury trial. The case highlights dram shop liability for serving minors.
