Shania O’Brien received a prison sentence for her role in a fatal hit-and-run in Butte, Montana. The case stemmed from a tragic incident during a fireworks celebration.
Incident Details
On July 3, 2023, O’Brien, then 20, drove her Jeep Wrangler on Granite Street after drinking and smoking marijuana. She struck 23-year-old Austin Nieves and his brother Connor, who were lighting fireworks in the street; Austin died from his injuries, while Connor survived with minor ones.
Legal Proceedings
O’Brien pleaded guilty in November 2024 to felony failure to render aid in an accident involving death. She fled the scene on foot but turned herself in the next day.
Sentencing Outcome
On February 10, 2026, Judge Mike Salvagni sentenced her to 7 years in the Montana Women’s Prison, with 5 years suspended, meaning she serves 2 years. She must also pay over $22,000 in restitution to Nieves’ family.
Court Arguments
Prosecutors sought 10 years (5 suspended), calling her flight “reprehensible” and self-preserving. Defense requested a deferred sentence, citing her remorse, clean record, and limited reaction time.
Judge’s Remarks
Salvagni condemned her failure to aid as inexcusable, recognizing the family’s grief. O’Brien apologized in court, expressing sorrow for the pain caused.
