A devastating case of alleged neglect in Indianapolis: 4-year-old Malachi Lovely, who had cerebral palsy, hip dysplasia, and couldn’t speak, was found unresponsive in a basement closet under the stairs on March 23, 2026. Blood stained his mouth, shirt, pillow, and blanket. His mother, Angel Lovely, 37, was giving CPR when police arrived at 4:25 p.m.; he died at a hospital.

Charges Filed

On April 1, Marion County prosecutors charged:

  • Angel Lovely: Two counts of neglect of a dependent resulting in death.
  • Boyfriend Nicholas Bergdoll, 36: Two counts of neglect of a dependent resulting in serious bodily injury.

Prosecutors say the pair “contributed to the boy’s many health conditions” by failing to provide or seek medical care.

Siblings’ Accounts

Two days later, Malachi’s three older siblings told detectives:

  • He was “trapped in the little room.”
  • “Mom does not take care of [him] as much.”
  • “Mom keeps him in the closet and does not pay attention to him.”

One sibling found him unresponsive. Parents claimed they were asleep.

Prosecutor Ryan Mears called it “absolutely devastating,” vowing a full investigation. No comment from defense. This highlights how vulnerable special-needs kids rely on caregivers—heartbreaking failure here. Investigation ongoing.
