A 28-year-old Wisconsin man is suspected of killing his own father, fatally shooting him during an altercation last week in front of a witness who was both the shooter’s ex-girlfriend and the victim’s stepdaughter.
Miguel Ocasio was arrested on November 14 and charged with one count of first-degree homicide with a modifier for using a dangerous weapon in the death of Miguel Arocho, according to court records.
According to court records obtained by Law&Crime, officers from the Milwaukee Police Department responded to a residence in the 1900 block of South 16th Street at 7:45 p.m. on Thursday, November 13. When first responders arrived, they reported finding an adult male, later identified as Arocho, with a gunshot wound to the head. He was pronounced dead on the scene.
A witness to the shooting informed authorities that Arocho had previously married her mother, making him her stepfather. She stated that she and her children had been living with Arocho when he was shot. The witness also claimed that Ocasio was the shooter, describing him as both her ex-boyfriend and Arocho’s biological son.
The witness stated that she had gone to Walmart earlier in the day with a male acquaintance, who then drove her back to Arocho’s residence. When they arrived at the house, Ocasio pulled up, attempted to unlock her door, and began accusing her of having a romantic involvement with the male buddy. The witness stated that she fled the car to protect her companion because she “knows her ex carries a gun.”
“Her friend then left and she tried entering the apartment, but her ex kept arguing with her,” according to the confession. “They were standing at the side door, when her ex pushed her in the face with his hand. Her ex continued to argue with her, which prompted her stepfather, [Arocho], to intervene. When her stepfather came down, she, her ex, and [Arocho] were standing on the gangway, arguing.”
The witness claimed she “attempted to calm the situation,” but Ocasio drew a revolver.
“She then tried to push her ex away, and she was able to push him to the sidewalk in front of the apartment,” according to the police. “At that point, her ex fired two rounds, but she doesn’t believe they hit anyone. After the gunshots, [Arocho] dashed inside but quickly exited. When he came out, she noticed nothing in her stepfather’s hands. At that point, she was either shoved or thrown to the ground, and she heard two gunshots. She got up and found that her stepfather had been shot.”
After the gunshot, the witness stated that Ocasio escaped on foot. He was apprehended by police the next day.
In an interview with police, Ocasio allegedly confessed to shooting his father. He claimed he was speaking with his ex-girlfriend when his father stepped outside and “threatened him with a firearm,” adding that “He, Ocasio, is not going to let anyone harm him.” He claimed he tried to leave when his father interrupted his “conversation” with his ex-girlfriend, but was “scared” when his father “threatened to shoot him,” so he fired a “warning shot.”
Ocasio said he met his ex-girlfriend, the witness, when his father married her mother.
“He only fired one warning shot because he believed his father was getting his gun,” according to the report. “When his father came outside, he was about to reach him, and Ocasio fired because he had been threatened and was afraid. When asked if he saw anything in his father’s hands, he said, “No.” He fired two rounds at his father, but he did not check on him since he was afraid and fled.
Ocasio is now being held at the Milwaukee County Jail in lieu of a $100,000 cash-only bond. He is expected to appear in court for a preliminary hearing on November 25th.
