A 34‑year‑old Texas delivery driver, Tanner Horner, has admitted to killing 7‑year‑old Athena Strand, abruptly ending what was set to be a wrenching trial and shifting the case into a penalty phase where jurors now decide whether he gets life in prison or the death penalty.
What Horner pleaded guilty to
Horner pleaded guilty on Tuesday to one count of capital murder and one count of aggravated kidnapping, charges stemming from the November 30, 2025, murder of Athena, who vanished while a FedEx package was being delivered to her home in Texas. Because prosecutors are seeking death, the jury must still weigh his punishment.
What prosecutors told the jury
In opening statements for the penalty phase, lead prosecutor Patrick Berry warned jurors about graphic audio evidence from inside the FedEx van, saying they would hear “what a 250‑pound man can do to a 67‑pound child” and that the sounds of Athena’s final moments would be unforgettable. He described the girl’s struggle as “warrior‑like,” emphasizing how hard she fought despite being trapped in the vehicle.
Family and investigative testimony
Athena’s stepmother, Elizabeth “Ashley” Strand, detailed the lasting trauma on the family, saying her other daughter now runs and hides from delivery drivers and suffers nightmares. Former Sheriff Lane Akin became emotional recounting the moment he told the family that Athena’s body had been found in a body of water about 10 miles from her home, emphasizing how desperately they had hoped she was still alive.
Investigators described how interior camera footage from the delivery truck allegedly showed Horner taking a young girl who looked like Athena into his van, then speaking with her before driving away. After being located, Horner reportedly confessed that he accidentally hit the child with his truck, panicked, put her in the van, and then decided to kill her for fear she would tell her father.
How Athena was killed
According to the arrest‑warrant affidavit, Horner told investigators he first tried to break Athena’s neck, then strangled her with his bare hands in the back of the FedEx van after that failed. Authorities said he later led them to a wooded area near the Trinity River in Boyd, Texas, where her body was found.
Athena’s mother, Maitlyn Gandy, had said the FedEx package Horner delivered contained a “You Can Be Anything” Barbie doll for her daughter, whom she planned to return to Oklahoma with after the holiday break.
Jurors will now hear additional evidence before deciding whether Horner should spend the rest of his life in prison or face the death penalty.
