A Kentucky couple is accused of committing a “despicable” crime by throwing their neighbor over a second-story balcony and killing him.
Shawn Durbin, 39, and Nancy Durbin, 36, face murder charges, according to Hardin County jail documents examined by Law&Crime. The former is also accused with resisting arrest and third-degree assault on a police officer.
On November 13, the Durbins were at Sugar Mill Apartments in Elizabethtown. A neighbor, 62-year-old Bobby Pennington, was also present at their apartment, but it is unclear why.
The Durbins and Pennington got into a fight, and the couple tossed the older guy off their second-floor balcony, which was about 12 feet high, onto the pavement below, according to the Elizabethtown Police Department. The TV station’s video shows a metal railing surrounding the outdoor space.
Officers were contacted about a guy in cardiac arrest, and when they arrived at the apartment building on the 100 block of East Memorial Drive, they discovered a lady performing CPR on Pennington. The woman claimed she saw the suspects throw him from the balcony.
Pennington was transported to a local Baptist Health hospital, where X-rays revealed he had a broken neck and ribs, reports WLKY. The couple was detained at the scene and initially charged with assault, but the charges were enhanced after Pennington died.
“It’s disgusting; it’s despicable.” “All indications are that he did nothing to deserve this,” Elizabethtown Police Department spokesperson Chris Denham said about the victim.
“There’s absolutely no ownership; it speaks volumes to the character of them,” Denham said of the suspects, who denied any participation in Pennington’s killing. “Best reports we can come up with are that Mr. Pennington didn’t bother anyone and was thrown off of almost a 12-foot balcony and ended his life.”
The accused are both detained at the Hardin County Detention Center and are scheduled to appear in court next month.
