Gustavo Elias, 29, has been charged with second-degree murder and reckless child abuse after mowing down 21-year-old Dezjon Hamilton with his Chevrolet Tahoe during a road rage confrontation.
The incident took place in Chandler, Arizona, on March 2024, after what police describe as a series of escalating confrontations between Elias and Hamilton.
The Incident
According to a probable cause affidavit obtained by Law&Crime, the confrontation between Elias and Hamilton began in the Walmart parking lot and continued into a heated exchange on the road.
Elias reportedly accused Hamilton of revving his motorcycle engine excessively and taunting him, which led to an altercation.
The confrontation reached a boiling point when Elias, with two children in the vehicle, allegedly rammed his car into Hamilton’s motorcycle after a series of incidents.
Police say Elias admitted to drinking 12 beers and taking cocaine before the crash. According to the affidavit, Elias and Hamilton lived in the same apartment complex and had previously clashed due to Hamilton revving his engine loudly and speeding through the parking lot.
Timeline of Events
The incident began around 1 p.m. on March 2024 when Hamilton allegedly revved his motorcycle’s engine in front of Elias’ Tahoe near Arizona and Ray Roads.
Elias followed Hamilton’s bike through a series of confrontations, and at one point, Hamilton reversed his bike and revved the engine at a red light.
Both vehicles traveled westbound on Ray Road, where Elias allegedly sped up and rammed his vehicle into Hamilton’s motorcycle. Witnesses reported that Elias intentionally struck the motorcycle, fully aware that children were present in the car, according to the affidavit.
The Aftermath
After the crash, Hamilton suffered a catastrophic cervical injury and was placed on a ventilator. He was later declared brain dead and taken off life support over the weekend. Hamilton’s family confirmed his death, with his sister telling local media, “It’s over.”
A GoFundMe set up for Hamilton’s family shares that his girlfriend is pregnant, and the family is committed to ensuring the unborn child grows up knowing how much Dezjon was loved.
Elias’ Arrest and Charges
Following the crash, Elias admitted his fault to a witness, saying, “I know this is my fault.” A breathalyzer test conducted on Elias revealed a blood alcohol concentration (BAC) of 0.158, nearly twice the legal limit of 0.08.
Elias has been charged with second-degree murder, reckless child abuse, and other offenses. He has been ordered held on a $500,000 cash-only appearance bond.
