A woman is suing her child’s middle school after claiming another classmate knocked him unconscious.

Jessica Berry filed the lawsuit on Nov. 26. She said that St. James Middle School, located at 9775 St. James Road in Myrtle Beach, was aware of the dangerous circumstances involving students but “allowed the bullying to continue unchecked.” Her son, designated as E.M. in the complaint, was injured as a result of another student’s concussion with loss of consciousness, face contusion, and cervical muscle strain.

The lawsuit also names Horry County Schools.

It is unclear whether any disciplinary action was taken against the students involved. A message left for Horry County Schools was not returned.

The injuries occurred on February 21, 2024, as pupils waited in the school hallway. The lawsuit alleges that pupils were not properly monitored at the time.

The staff did not summon emergency personnel to the school premises, according to the lawsuit. Instead, school personnel contacted E.M.’s mother, who arrived to pick up her son and transport him to the emergency hospital, according to the lawsuit.

According to the lawsuit, no event report was issued or submitted to the parents.

St. James Middle School is ranked in the top 50 percent of South Carolina schools. The school achieved an overall score of 49 out of 100 on the 2024 School Report Card ratings.
